In case of differences, the German version of these terms applies.<\/em><\/p>\n<h2>1. Scope<\/h2>\n<p>1.1 These general terms and conditions (hereinafter &laquo;GTC&raquo;) apply to all business relationships between Kuster Fine Wines (hereinafter &laquo;Kuster Fine Wines&raquo;) and its customers (hereinafter &laquo;customer&raquo;) in connection with the sale and import of wine.<\/p>\n<p>1.2 The offering is addressed to natural persons of legal age as well as to companies and other legal entities with a place of delivery or collection in Switzerland.<\/p>\n<p>1.3 These GTC apply to all order requests, orders and contracts of sale concluded via the website of Kuster Fine Wines, by email or by any other means.<\/p>\n<p>1.4 By sending an order request, the customer confirms that they have read and taken note of these GTC.<\/p>\n<h2>2. Offering and planned joint imports<\/h2>\n<p>2.1 Kuster Fine Wines offers selected wines, in particular from small and independent producers in Piemonte and other wine regions.<\/p>\n<p>2.2 The business model of Kuster Fine Wines is based in part on planned joint imports. The wines offered on the website are therefore not necessarily held in stock in Switzerland.<\/p>\n<p>2.3 The wines are procured on the basis of the order requests received, consolidated at the producers and brought into Switzerland as part of a planned import.<\/p>\n<p>2.4 The wines, prices, vintages and expected delivery periods shown on the website do not, as a rule, constitute a binding offer to conclude a contract of sale.<\/p>\n<p>2.5 The customer can submit an order request for the desired wines via the website.<\/p>\n<p>2.6 By sending the order request, the customer does not yet commit to a purchase. The order request constitutes an offer by the customer to conclude a contract of sale.<\/p>\n<p>2.7 Kuster Fine Wines checks availability, quantities, prices and the possibility of procurement and import.<\/p>\n<p>2.8 A binding contract of sale is concluded only once Kuster Fine Wines expressly confirms the order request by email.<\/p>\n<p>2.9 The confirmation states in particular the wines ordered, quantities, prices and the expected date of availability in Switzerland and, where applicable, the delivery or collection conditions.<\/p>\n<p>2.10 An automatic email merely confirming receipt of an order request does not constitute acceptance of the order request and does not create a contract of sale.<\/p>\n<h2>3. Minimum order value<\/h2>\n<p>3.1 The minimum order value per order is CHF 50.&ndash;.<\/p>\n<p>3.2 Wines can be combined freely. The customer can put together different wines and quantities in one order.<\/p>\n<h2>4. Availability and procurement<\/h2>\n<p>4.1 The availability of the wines offered may be limited, as some producers make only small quantities.<\/p>\n<p>4.2 The presentation of a wine on the website does not mean that it is available at all times in the desired quantity.<\/p>\n<p>4.3 Kuster Fine Wines endeavours to keep the presentation of range, vintage, prices and availability as current as possible. Changes remain reserved.<\/p>\n<p>4.4 If an ordered wine cannot be procured after receipt of the order request, or not in the desired quantity, Kuster Fine Wines informs the customer.<\/p>\n<p>4.5 In such a case Kuster Fine Wines may:<\/p>\n<ul>\n<li>offer a different available vintage;<\/li>\n<li>offer a reduced quantity;<\/li>\n<li>propose a comparable wine; or<\/li>\n<li>remove the position in question from the order request.<\/li>\n<\/ul>\n<p>4.6 A different vintage or a different wine is delivered only with the customer&rsquo;s consent.<\/p>\n<p>4.7 If an order cannot be executed, or only in part, because of lack of availability, the customer is not charged for wines that are not delivered. Payments already made for wines that are not delivered are refunded.<\/p>\n<h2>5. Planned imports and delivery times<\/h2>\n<p>5.1 Kuster Fine Wines organises the procurement and import of the wines as a rule within planned joint imports.<\/p>\n<p>5.2 The website may state an expected order and delivery period for the respective import.<\/p>\n<p>5.3 This information serves as guidance and does not, as a rule, constitute a binding delivery deadline.<\/p>\n<p>5.4 The actual date of availability in Switzerland may depend in particular on availability at the producer, the composition of the joint import, transport, customs clearance and further import formalities.<\/p>\n<p>5.5 Kuster Fine Wines informs the customer by email, where possible, of material changes to the expected delivery period.<\/p>\n<p>5.6 The customer is informed as soon as the wines ordered have arrived in Switzerland and are ready for collection or delivery.<\/p>\n<h2>6. Prices and value added tax<\/h2>\n<p>6.1 All prices are stated in Swiss francs (CHF).<\/p>\n<p>6.2 The prices stated on the website refer to the respective bottle or sales unit.<\/p>\n<p>6.3 The prices stated are in Swiss francs. Kuster Fine Wines is currently not liable to value added tax and therefore does not show Swiss VAT.<\/p>\n<p>6.4 Should Kuster Fine Wines become liable to value added tax in future, pricing and the presentation of VAT will be adjusted in accordance with the statutory provisions.<\/p>\n<p>6.5 Any shipping, delivery or other additional costs are communicated to the customer before the contract of sale is concluded and are shown in the order confirmation.<\/p>\n<p>6.6 The prices confirmed by Kuster Fine Wines in the individual confirmation are decisive for the contract of sale.<\/p>\n<p>6.7 Price changes for future order requests remain reserved.<\/p>\n<h2>7. Payment terms<\/h2>\n<p>7.1 The payment terms are communicated to the customer with the order confirmation or invoice.<\/p>\n<p>7.2 Kuster Fine Wines may require payment in particular by bank transfer, through an electronic payment service offered, or on collection.<\/p>\n<p>7.3 Invoices are due for payment within 10 days of the invoice date.<\/p>\n<p>7.4 Kuster Fine Wines may make orders subject to payment in advance, in particular for new customers.<\/p>\n<p>7.5 In the event of late payment, Kuster Fine Wines is entitled to withhold the execution of further orders until outstanding amounts have been settled in full.<\/p>\n<h2>8. Retention of title<\/h2>\n<p>8.1 The wines delivered or made available for collection remain the property of Kuster Fine Wines until the purchase price has been paid in full.<\/p>\n<p>8.2 In the event of late payment, Kuster Fine Wines is entitled to refuse to hand over goods that have not yet been paid for, or to demand their return, to the extent permitted by law.<\/p>\n<h2>9. Delivery and collection<\/h2>\n<p>9.1 As soon as the wines ordered have arrived in Switzerland and are ready to be handed over, the customer is informed by email.<\/p>\n<p>9.2 Depending on the option agreed, the order can be:<\/p>\n<ul>\n<li>collected at an agreed location; or<\/li>\n<li>delivered to the delivery address in Switzerland stated by the customer.<\/li>\n<\/ul>\n<p>9.3 The available delivery and collection options and any costs are communicated to the customer at the latest with the order confirmation or before delivery.<\/p>\n<p>9.4 The customer is obliged to provide a correct and complete delivery address and to make acceptance of the delivery possible.<\/p>\n<p>9.5 If a delivery cannot be made because of an incorrect or incomplete address, the absence of the customer or any other reason for which the customer is responsible, any additional costs arising may be charged to the customer.<\/p>\n<p>9.6 In the case of collection, the order must be collected within the period agreed with Kuster Fine Wines.<\/p>\n<h2>10. Age restriction<\/h2>\n<p>10.1 The sale and handing over of alcoholic beverages to persons below the legally prescribed minimum age is not permitted.<\/p>\n<p>10.2 By sending an order request, the customer confirms that they have reached the legally prescribed minimum age for the purchase of the alcoholic beverages ordered.<\/p>\n<p>10.3 Kuster Fine Wines is entitled to request suitable proof of age on delivery or collection.<\/p>\n<p>10.4 If the required proof of age is not provided, the handing over of the goods may be refused.<\/p>\n<h2>11. Inspection of the delivery and complaints<\/h2>\n<p>11.1 The customer is obliged to check the delivery, or the goods taken over on collection, for completeness and recognisable damage as soon as possible after receipt.<\/p>\n<p>11.2 Obvious transport damage or missing bottles must be reported to Kuster Fine Wines in writing or by email, if possible within 5 calendar days of receipt. We ask the buyer to check the condition of the goods received immediately upon receipt. After 5 calendar days have passed, the delivery is deemed approved.<\/p>\n<p>11.3 In the case of transport damage, the customer should have the damage documented directly by the transport service provider and send photographs of the damaged packaging and goods to Kuster Fine Wines.<\/p>\n<h2>12. Wine quality and natural characteristics<\/h2>\n<p>12.1 Wine is a natural product. Differences in colour, aroma, taste and development can occur within a vintage and between individual bottles.<\/p>\n<p>12.2 Even with proper storage, natural changes typical of wine can occur.<\/p>\n<p>12.3 In particular, a wine may show what is known as cork taint or another fault typical of wine.<\/p>\n<p>12.4 Unfortunately we cannot prevent faults caused by the cork. Our pricing does not allow us to take such wines back. Corks are natural products in which faults cannot be entirely ruled out. This risk is borne by the customer.<\/p>\n<h2>13. Cancellation by the customer<\/h2>\n<p>13.1 An order request can be withdrawn by the customer at any time free of charge, as long as it has not yet been expressly confirmed by Kuster Fine Wines.<\/p>\n<p>13.2 The contract of sale is concluded with the express confirmation by Kuster Fine Wines.<\/p>\n<p>13.3 As the wines are in part procured on the basis of individual orders and brought into Switzerland within a planned import, there is as a rule no general right to cancel free of charge once the contract of sale has been concluded.<\/p>\n<p>13.4 Kuster Fine Wines may agree to a subsequent cancellation on a voluntary basis.<\/p>\n<p>13.5 Where a cancellation is accepted, costs already incurred and unavoidable, in particular procurement, transport, import or payment fees, may be charged to the customer.<\/p>\n<h2>14. No general right of withdrawal<\/h2>\n<p>14.1 For contracts of sale concluded in Switzerland there is as a rule no general statutory 14-day right of withdrawal for online purchases.<\/p>\n<p>14.2 Kuster Fine Wines grants no general right of return for wines delivered properly and free of defects, unless expressly agreed otherwise.<\/p>\n<p>14.3 The customer&rsquo;s statutory rights in the case of defective goods remain unaffected.<\/p>\n<h2>15. Data protection<\/h2>\n<p>15.1 Personal data is processed in accordance with the privacy policy of Kuster Fine Wines published on the website.<\/p>\n<p>15.2 Personal data is processed in particular for handling order requests, orders, payments, imports, deliveries and the related customer communication.<\/p>\n<p>15.3 Where this is necessary to process the order, data may be passed on to commissioned service providers, in particular transport, logistics, payment and IT service providers.<\/p>\n<h2>16. Intellectual property<\/h2>\n<p>16.1 All content of the website of Kuster Fine Wines, in particular texts, images, logos, graphics, product descriptions and other content, is protected by copyright.<\/p>\n<p>16.2 Reproduction, editing, distribution or any other use of the content is not permitted without the prior written consent of Kuster Fine Wines, unless expressly allowed by law.<\/p>\n<h2>17. Changes to the GTC<\/h2>\n<p>17.1 Kuster Fine Wines reserves the right to amend these GTC at any time.<\/p>\n<p>17.2 For a contract of sale already concluded, the GTC valid at the time the contract was concluded apply.<\/p>\n<p>17.3 For future order requests, the GTC published on the website www.boutiquedelvino.ch apply.<\/p>\n<h2>18. Applicable law and place of jurisdiction<\/h2>\n<p>18.1 Swiss law applies to all legal relationships between Kuster Fine Wines and the customer.<\/p>\n<p>18.2 Subject to mandatory statutory places of jurisdiction, the place of jurisdiction is the registered office of Kuster Fine Wines in Switzerland.<\/p>\n<h2>20.
